# Conflict of Interest Policy

**Introduction**

The Department of Justice (DOJ) is committed to maintaining integrity, transparency, and accountability in all operations. To uphold public trust and ensure ethical behavior, this Conflict of Interest Policy outlines standards for identifying, disclosing, and addressing potential conflicts of interest.

A conflict of interest arises when an individual's personal, financial, or professional interests interfere with their responsibilities or decision-making within the DOJ. This policy applies to all DOJ employees, contractors, and officials.

**Purpose**

The purpose of this policy is to:

* Ensure fairness and impartiality in all DOJ decisions and actions.
* Prevent situations where personal interests compromise professional responsibilities.
* Provide clear guidelines for identifying, managing, and disclosing conflicts of interest.

**Scope**

This policy applies to:

* All DOJ employees, including legal professionals, judges, law enforcement, and administrative staff.
* Contractors, consultants, and third-party entities working with the DOJ.

**What Constitutes a Conflict of Interest**

A conflict of interest may include, but is not limited to:

1. **Personal Gain:**
   * Using one's position within the DOJ for personal or financial gain.
   * Participating in decisions that affect personal business interests or those of close relatives or friends.
2. **Dual Employment or Roles:**
   * Engaging in outside employment or roles that interfere with DOJ duties.
   * Accepting gifts, favors, or incentives from external parties with pending or active dealings with the DOJ.
3. **Financial Interests:**
   * Holding financial interests in businesses or entities involved in DOJ matters.
   * Contracting or awarding funds to personal or related entities.
4. **Relationships:**
   * Participating in cases or decisions involving close personal relationships (e.g., family members, close friends).
   * Supervising individuals with whom there is a personal relationship.

**Responsibilities of DOJ Personnel**

All DOJ employees are responsible for:

1. **Disclosure:**
   * Promptly reporting any potential or actual conflicts of interest to their supervisor, department head, or the designated ethics officer.
2. **Recusal:**
   * Removing themselves from decisions or actions where a conflict of interest exists.
3. **Compliance:**
   * Following all DOJ policies, including this Conflict of Interest Policy, and cooperating in any reviews or investigations of conflicts.

**Disclosure and Reporting Process**

1. **Initial Disclosure:**
   * Employees must disclose any potential conflicts of interest upon hiring or when new responsibilities are assigned.
2. **Ongoing Disclosure:**
   * Any new potential or actual conflicts must be reported immediately.
3. **Reporting:**
   * Disclosures should be submitted in writing to the Ethics Office or the employee's supervisor using the **Conflict of Interest Disclosure Form** provided by the DOJ.

**Management of Conflicts**

Upon disclosure of a conflict, the DOJ will take the following steps:

1. **Assessment:**
   * The Ethics Office will review the disclosure to determine the extent and nature of the conflict.
2. **Resolution:**
   * Appropriate measures will be taken to resolve the conflict, such as reassignment, recusal, or restricting certain actions.
3. **Documentation:**
   * All disclosures and resolutions will be documented and stored securely by the Ethics Office.

Failure to disclose or address a conflict of interest may result in:

* Disciplinary action, up to and including termination of employment.
