# Crime Victims' Rights

#### **Overview**

This section outlines the rights guaranteed to victims of crime under the San Andreas justice system. These rights ensure that victims are treated with dignity, fairness, and respect throughout the criminal justice process. Law enforcement officers, legal professionals, and government agencies are responsible for upholding these rights during investigations, prosecutions, and post-conviction proceedings.

#### **Rights of Crime Victims**

1. **Protection from the Accused**
   * Victims have the right to be reasonably protected from the accused.
2. **Notification of Proceedings**
   * Victims have the right to reasonable, accurate, and timely notice of:
     * Any public court proceeding.
     * Any parole proceeding.
     * The release or escape of the accused.
3. **Presence in Court Proceedings**
   * Victims have the right not to be excluded from any public court proceeding unless:
     * The court, after receiving clear and convincing evidence, determines that the victim’s testimony would be materially altered if they heard other testimony during the proceeding.
4. **Participation in Court Proceedings**
   * Victims have the right to be reasonably heard at any public proceeding involving:
     * Release.
     * Plea.
     * Sentencing.
     * Parole.
5. **Consultation with Government Attorneys**
   * Victims have the right to confer with the attorney for the government handling their case.
6. **Restitution**
   * Victims have the right to full and timely restitution as provided by law.
7. **Timely Proceedings**
   * Victims have the right to proceedings free from unreasonable delay.
8. **Dignity and Privacy**
   * Victims have the right to be treated with fairness and respect for their dignity and privacy, including protections from:
     * Unlawful searches.
     * Detainment without reasonable suspicion.
     * Coerced or forced statements.
9. **Information on Plea Bargains or Agreements**
   * Victims have the right to be informed in a timely manner of:
     * Any plea bargain.
     * Deferred prosecution agreements.
10. **Information on Rights**
    * Victims have the right to be informed of their rights under this section and provided with contact information for the Department of Justice.

Law enforcement officers, prosecutors, and government agencies must:

* Proactively ensure that victims are aware of and can exercise their rights.
* Provide resources, such as victim advocates, to assist victims throughout the judicial process.
* Notify victims promptly of all relevant developments in their case.
