# Defensible Conditions and Citizen Protection Doctrine

**Introduction**\
The Self-Defense Doctrine provides the legal framework for justifying the use of force, including lethal force, by civilians in specific situations where they face threats to their personal safety, property, or the safety of others. It establishes the conditions under which such actions are considered lawful and outlines the limitations and responsibilities of individuals acting in self-defense.

***

#### **Standing One’s Ground ("Stand Your Ground")**

Civilians, when faced with the threat of violence, injury, or loss of property, have no duty to retreat from the threat. This principle affirms that individuals are not required to flee and may defend themselves up to and including the use of lethal force to stop the immediate threat against them.

**Application**:

* A civilian may use force proportional to the threat they face.
* Lethal force is justified only when the threat involves the risk of serious injury, death, or significant loss of property.
* Self-defense actions must cease once the threat is neutralized.

***

#### **Bystander Protection, Good Samaritans, and Citizen’s Arrest**

While **Felony Vigilantism** prohibits civilians from performing law enforcement duties without legal authority, the doctrine recognizes that civilians may intervene to protect the life or property of others under specific conditions.

**Key Principles**:

* Civilians witnessing a misdemeanor or felony involving violence or property theft may act to stop the crime.
* Intervention must be reasonable, proportional, and aimed at protecting the victim.
* If intervention includes restraining the suspect from fleeing, the action may qualify as a **Citizen’s Arrest**, provided it does not exceed reasonable force.

This doctrine provides civilians with legal protection for Good Samaritan actions undertaken in good faith to defend others.

***

#### **Castle Doctrine**

The Castle Doctrine reinforces the right of individuals to protect themselves and their property when faced with threats while on their own property or within their legal residence.

**Application**:

* Residents have no duty to retreat when faced with violence, theft, or property damage on their premises.
* Force, including lethal force, is justified against intruders who attempt to break in, steal, or chronically trespass.
* Actions taken under this doctrine must be reasonable and necessary to stop the threat.

***

#### **Duress by Threats**

The doctrine of Duress by Threats provides limited absolution for criminal liability when an individual is coerced into committing an offense due to credible threats of harm. However, this defense does not apply to crimes involving murder or homicide.

**Conditions for Validity**:

1. The defendant must be a victim of credible threats under \[4] 21 - Threats to Participate in a Criminal Organization, \[1] 8 - Criminal Threats, or \[5] 1 - Extortion.
2. A **reasonable person** or jury must conclude that the following criteria are met:
   * The defendant reasonably believed they were threatened with death or serious injury against themselves or others if they did not cooperate.
   * The defendant reasonably believed they had no safe alternative to escape harm without committing the offense.

If both conditions are satisfied beyond a reasonable doubt, the defendant may be absolved of liability, except in cases involving murder.

***

#### **Wild Animal Defense**

Civilians are permitted to use lethal force against wild animals displaying aggressive behavior toward humans. This defense ensures public safety while mandating humane treatment of animals.

**Key Guidelines**:

* Lethal force must be proportional to the animal's threat.
* The act of neutralizing the animal must be conducted humanely.
* Individuals are immune from prosecution under LSMC 3 - Unlawful Discharge of a Weapon Within City Limits if acting under this doctrine.
* Prolonged or cruel neutralization of the animal voids this protection and may result in charges of **Animal Cruelty**.

***

#### **Legal Considerations and Limitations**

The Self-Defense Doctrine outlines clear protections for civilians acting in defense of themselves, others, or their property. However, these protections are not absolute and require that actions are reasonable, proportional, and justifiable under the specific circumstances.

* Unjustified or excessive use of force may result in criminal charges or civil liability.
* Individuals must be prepared to articulate their actions in court if challenged.

***

#### **Conclusion**

The Self-Defense Doctrine provides civilians with the legal authority to protect themselves, others, and their property in situations where threats are imminent and unavoidable. By setting clear guidelines for reasonable and proportional responses, the doctrine ensures that self-defense actions are both lawful and ethical, balancing the rights of individuals with the principles of justice and accountability.
