# \[1] 12 - Kidnapping (1st Degree)

**Offense Classification: Felony**

**Definition:**

Kidnapping in the first degree occurs when an individual **unlawfully abducts, restrains, or confines another person against their will** under **aggravating circumstances**, such as **ransom, hostage-taking, or intent to cause serious harm or death**.

**Elements of the Crime:**

* The suspect **forcefully or unlawfully restrained, confined, or abducted the victim**.
* The act was **without the victim’s consent** and against their will.
* The suspect **held the victim for ransom, as a hostage, or intended serious harm**.
* The act was **not justified** (e.g., not lawful detainment by law enforcement).

**Penalties:**

* **Jail Time:** 25 years to life
* **Fine:** Up to $50,000
* **Additional Consequences:** No parole eligibility in certain cases, enhanced penalties if the victim was injured
