# \[1] 13 - Kidnapping (2nd Degree)

**Offense Classification: Felony**

**Definition:**

Kidnapping in the second degree occurs when an individual **unlawfully abducts, restrains, or confines another person against their will** **without aggravating factors** such as ransom demands, bodily harm, or intent to kill. This charge applies when the act is serious but lacks the extreme circumstances required for **first-degree kidnapping**.

**Elements of the Crime:**

* The suspect **forcefully or unlawfully restrained, confined, or abducted** the victim.
* The act was **without the victim’s consent** and against their will.
* The suspect **did not demand ransom, cause injury, or plan serious harm**.
* The act was **not justified** (e.g., not legal detainment by law enforcement).

**Penalties:**

* **Jail Time:** 10 to 25 years
* **Fine:** Up to $35,000
* **Additional Consequences:** Probation restrictions, possible restraining orders
