# \[1] 14 - Hostage Taking

**Offense Classification: Felony**

**Definition:**

Hostage Taking occurs when an individual **forcibly restrains or confines another person and uses them as leverage or bargaining power** to demand ransom, influence decisions, or evade law enforcement.

**Elements of the Crime:**

* The suspect **unlawfully restrained or confined** the victim.
* The suspect **used the victim as leverage** to demand something in return.
* The act was **not justified** (e.g., not lawful detainment).

**Penalties:**

* **Jail Time:** 25 years to life
* **Fine:** Up to $75,000
* **Additional Consequences:** Federal investigation, increased penalties if law enforcement was targeted
