# \[1] 15 - Harassment (1st Degree)

**Offense Classification:** Misdemeanor / Felony *(Depending on severity)*

**Definition:**

Harassment in the first degree occurs when an individual **repeatedly engages in behavior that causes another person to feel threatened, intimidated, or in fear for their safety**. This includes **stalking, persistent unwanted communication, or credible threats of harm**.

**Elements of the Crime:**

* The suspect **engaged in repeated or continuous conduct** toward the victim.
* The behavior **caused emotional distress, fear, or intimidation**.
* The suspect **acted willfully and without a lawful purpose**.
* The act was **not justified** (e.g., not protected speech or lawful conduct).

**Penalties:**

* **Jail Time:** Up to 12 months *(Misdemeanor)*, up to 3 years *(Felony, if threats were credible)*
* **Fine:** Up to $5,000
* **Additional Consequences:** Restraining orders, mandatory counseling, increased penalties for repeat offenses
