# \[1] 16 - Harassment (2nd Degree)

**Offense Classification:** Misdemeanor

**Definition:**

Harassment in the second degree occurs when an individual **engages in unwanted conduct, communication, or behavior that annoys, alarms, or disturbs another person**, but does not pose an immediate threat to their safety. This includes **repeated unwanted contact, verbal abuse, or minor acts of intimidation**.

**Elements of the Crime:**

* The suspect **engaged in conduct that was knowingly annoying or alarming**.
* The behavior **was repeated or persistent** and **caused emotional distress**.
* The conduct **did not involve credible threats of violence** or serious intimidation.
* The act was **not justified** (e.g., not lawful free speech or protected conduct).

**Penalties:**

* **Jail Time:** Up to 6 months
* **Fine:** Up to $2,500
* **Additional Consequences:** Restraining orders, community service, mandatory counseling
