# \[1] 17 - Stalking

**Offense Classification: Misdemeanor / Felony&#x20;*****(Depending on severity)***

**Definition:**

Stalking occurs when an individual **repeatedly follows, harasses, or surveils another person**, causing **fear, emotional distress, or a reasonable belief of being in danger**.

**Elements of the Crime:**

* The suspect **engaged in repeated, unwanted contact** with the victim.
* The behavior **caused the victim to fear for their safety or well-being**.
* The suspect’s actions were **persistent and intentional**.
* The act was **not justified** (e.g., not lawful surveillance by authorities).

**Penalties:**

* **Jail Time:** Up to 12 months *(Misdemeanor)*, up to 5 years *(Felony, if threats or physical harm occurred)*
* **Fine:** Up to $10,000
* **Additional Consequences:** Restraining orders, mandatory counseling, possible GPS monitoring
