# \[1] 18 - Criminal Threats

**Offense Classification: Misdemeanor / Felony&#x20;*****(Depending on severity)***

**Definition:**

Criminal Threats occur when an individual **threatens to cause serious bodily harm or death** to another person, **intentionally creating fear**, even if they do not act on the threat. The threat must be **specific, credible, and cause the victim to reasonably fear for their safety**.

**Elements of the Crime:**

* The suspect **made a direct, specific threat** of harm or death.
* The victim **reasonably believed the threat was serious and imminent**.
* The threat was **delivered verbally, in writing, electronically, or through gestures**.
* The act was **not justified** (e.g., not a joke or protected speech).

**Penalties:**

* **Jail Time:** Up to 12 months *(Misdemeanor)*, up to 5 years *(Felony, if threats were serious or repeated)*
* **Fine:** Up to $10,000
* **Additional Consequences:** Restraining orders, mandatory anger management, increased penalties for threats against public officials
