# \[1] 2 - Assault (2nd Degree)

**Offense Classification: Misdemeanor / Felony**

**Definition:**

Assault in the second degree occurs when an individual **intentionally causes bodily harm** to another person but the injuries are **less severe than first-degree assault** or the act involves reckless conduct that results in injury.

**Elements of the Crime:**

* The suspect **intended to cause** harm, but the injuries were **not life-threatening**.
* The assault may have been **committed recklessly** but still resulted in bodily harm.
* The act was **not justified** (e.g., not self-defense).

**Penalties:**

* **Jail Time:** Up to 12 months
* **Fine:** $3,500
* **Additional Consequences:** Community service, probation, restitution to the victim
