# \[1] 26 - Unlawful Imprisonment of a Public Servant/Peace Officer

**Offense Classification:** Felony

**Definition:**\
This offense occurs when an individual unlawfully restrains a public servant or peace officer without consent and without legal authority, and the act interferes with or is connected to the performance of official duties. The offense applies when the suspect knew or reasonably should have known the person was a public servant or peace officer.

**Elements of the Crime:**

* The victim was a public servant or peace officer engaged in or in connection with official duties.
* The suspect knowingly restrained the victim without consent or legal authority.
* The restraint substantially interfered with the victim’s freedom of movement or performance of duties.
* The suspect knew or reasonably should have known of the victim’s status.

**Penalties:**

* Jail Time: 24 to 30 months
* Fine: 1,500 dollars to 3,500 dollars
* Additional Consequences: Protective order eligibility, probation limits, mandatory counseling, court ordered training regarding interference with public duties
