# \[1] 28 - Attempted Murder of a Public Servant/Peace Officer

**Offense Classification:** Felony

**Definition:**\
This offense occurs when an individual takes a substantial step toward intentionally causing the death of a public servant or peace officer who is performing official duties. The offense applies when the suspect knew or reasonably should have known the victim’s status.

**Elements of the Crime:**

* The suspect acted with the specific intent to kill.
* The victim was a public servant or peace officer engaged in or in connection with official duties.
* The suspect took a substantial step toward committing the killing.
* The suspect knew or reasonably should have known of the victim’s status.

**Penalties:**

* Jail Time: 28 to 35 months
* Fine: 2,000 dollars to 4,500 dollars
* Additional Consequences: Firearm possession restrictions, no contact orders, mandatory counseling, long term probation conditions
