# \[1] 29 - Murder of a Public Servant/Peace Officer

**Offense Classification:** Felony

**Definition:**\
Murder of a public servant or peace officer occurs when an individual intentionally causes the death of a public servant or peace officer while the victim is performing official duties. The offense applies when the suspect knew or reasonably should have known the victim’s status.

**Elements of the Crime:**

* The suspect intentionally caused the death of the victim.
* The victim was a public servant or peace officer engaged in or in connection with official duties.
* The suspect knew or reasonably should have known of the victim’s status.
* The killing was not justified or excused by law.

**Penalties:**

* Jail Time: 35 to 50 months
* Fine: 5,000 dollars to 10,000 dollars
* Additional Consequences: Restitution to victims, firearm prohibition, lifetime protective orders as permitted, extended parole or probation eligibility restrictions
