# \[1] 33 - Accessory to Second-Degree Murder

**Offense Classification:** Felony

**Definition:**\
An individual is an accessory to second degree murder when, knowing that another person has committed or attempted an intentional killing that was not premeditated, or a killing resulting from extreme recklessness, the individual aids, assists, or conceals that person with the intent to hinder apprehension or punishment.

**Elements of the Crime:**

* Another person committed or attempted second degree murder.
* The suspect knew of the commission or attempt.
* The suspect provided aid, assistance, concealment, or resources.
* The suspect intended to hinder apprehension or punishment.

**Penalties:**

* Jail Time: 22 to 30 months
* Fine: 1,750 dollars to 3,500 dollars
* Additional Consequences: No contact orders, probation, community service, restitution as appropriate
