# \[1] 34 - Gang-Related Shooting

**Offense Classification:** Felony

**Definition:**\
Gang related shooting occurs when an individual discharges a firearm at or toward a person, occupied vehicle, occupied structure, or into a public place, with the intent to injure, kill, or intimidate, and the act is committed for the benefit of, at the direction of, or in association with a criminal street gang.

**Elements of the Crime:**

* The suspect discharged a firearm.
* The discharge was directed at a person, occupied vehicle, occupied structure, or into a public place.
* The suspect intended to injure, kill, or intimidate.
* The act was for the benefit of, at the direction of, or in association with a gang.

**Penalties:**

* Jail Time: 28 to 40 months
* Fine: 3,000 dollars to 6,000 dollars
* Additional Consequences: Firearm prohibition, gang injunction conditions, no contact orders, restitution for damages
