# \[1] 35 - Desecration of a Corpse

**Offense Classification:** Felony

**Definition:**\
Desecration of a corpse occurs when an individual knowingly mutilates, disfigures, dismembers, disinters without authority, or otherwise treats a human corpse in a manner that would outrage ordinary family sensibilities, without lawful authority.

**Elements of the Crime:**

* The object of the conduct was a human corpse or human remains.
* The suspect knew or reasonably should have known it was a human corpse.
* The suspect mutilated, disfigured, dismembered, disinterred without authority, or otherwise mistreated the remains.
* The act was without lawful authority.

**Penalties:**

* Jail Time: 20 to 30 months
* Fine: 1,500 dollars to 3,500 dollars
* Additional Consequences: Restitution for related damages, mandatory counseling, community service, prohibition from certain professional licenses as applicable
