# \[1] 36 - Cannibalism

**Offense Classification:** Felony

**Definition:**\
Cannibalism occurs when an individual knowingly consumes the flesh or internal organs of a human being without lawful authority. This includes ingestion of any portion of human remains that are not lawfully provided for medical or scientific purposes.

**Elements of the Crime:**

* The material consumed consisted of human flesh or internal organs.
* The suspect knew or reasonably should have known the material was human.
* The consumption was intentional.
* The act was without lawful authority.

**Penalties:**

* Jail Time: 30 to 45 months
* Fine: 4,000 dollars to 7,500 dollars
* Additional Consequences: Mandatory psychological evaluation and counseling, probation restrictions, community service, restitution as appropriate
