# \[1] 5 - Assault with a Deadly Weapon (ADW)

**Offense Classification: Felony**

**Definition:**

Assault with a Deadly Weapon occurs when an individual **uses a firearm, knife, bat, or any other deadly weapon** to attack or threaten another person with serious bodily harm.

**Elements of the Crime:**

* The suspect **used or brandished** a deadly weapon in an assault.
* The victim was **threatened or injured** as a result.
* The assault was **not justified** (e.g., not self-defense).

**Penalties:**

* **Jail Time:** Up to 40 months
* **Fine:** $15,000
* **Additional Consequences:** Weapon confiscation, potential firearm ownership ban
