# \[1] 6 - Assaulting a Police Officer

**Offense Classification: Felony**

**Definition:**

Assaulting a Police Officer occurs when an individual **knowingly and intentionally uses force, threatens, or attempts to cause harm** to a law enforcement officer while they are performing their duties. This includes **physical attacks, aggressive resistance during arrest, or using a deadly weapon against an officer**.

**Elements of the Crime:**

* The suspect **knowingly assaulted** a police officer.
* The officer was **engaged in lawful duties** at the time of the assault.
* The suspect’s actions **were intentional and not accidental**.
* The act was **not justified** (e.g., not self-defense from excessive force).

**Penalties:**

* **Jail Time:** 5 to 15 years
* **Fine:** Up to $25,000
* **Additional Consequences:** Extended parole restrictions, mandatory anger management, increased penalties for use of weapons
