# \[1] 7 - Murder (1st Degree)

**Offense Classification:** Felony

**Definition:**

Murder in the first degree is the **intentional and premeditated killing** of another person. This includes killings that were **planned in advance**, carried out with **malice aforethought**, or committed during the course of another serious felony (felony murder rule).

**Elements of the Crime:**

* The suspect **deliberately planned** and intended to kill the victim.
* The act was carried out **with malice aforethought** (a willful intent to end a life).
* The killing was **not justified** (e.g., not self-defense or legally excused).
* May also apply under the **felony murder rule**, where a victim is killed during the commission of another felony (e.g., armed robbery, kidnapping).

**Penalties:**

* **Jail Time:** Life in prison (with or without parole)
* **Fine:** Up to $50,000
* **Additional Consequences:** No chance of parole (depending on circumstances), potential death penalty (if applicable in jurisdiction)
