# \[1] 8 - Murder (2nd Degree)

**Offense Classification:** Felony

**Definition:**

Murder in the second degree is the **intentional killing of another person without premeditation**. This charge applies when the suspect **acted with intent to kill but without prior planning**, or when an individual’s reckless disregard for life results in death.

**Elements of the Crime:**

* The suspect **intended to kill** the victim but **did not premeditate the act**.
* The killing was carried out with **malice aforethought**, meaning the suspect acted with **reckless disregard for human life**.
* The act was **not justified** (e.g., not self-defense or legally excused).

**Penalties:**

* **Jail Time:** 25 years to life
* **Fine:** Up to $35,000
* **Additional Consequences:** Possible parole restrictions, potential lifetime monitoring
