# \[2] 1 - Trespassing

**Offense Classification:** Misdemeanor / Felony (Depending on circumstances)

**Definition:**\

Trespassing occurs when an individual knowingly enters or remains on another person’s property without permission or legal right to do so. This charge applies when entry is unauthorized but does not involve force or intent to commit another crime. Trespassing may occur on private property, restricted public areas, or posted land.

**Elements of the Crime:**

* The suspect entered or remained on property without the owner’s or lawful occupant’s consent.
* The suspect was aware or reasonably should have been aware that entry was prohibited (e.g., posted signs, verbal warnings).
* The suspect did not have legal authority to be present.
* The act was not justified (e.g., emergency or lawful entry under government authority).

**Penalties:**

* **Jail Time:** Up to 6 months (Misdemeanor), up to 2 years (Felony if armed or repeat offense).
* **Fine:** Up to $2,500
* **Additional Consequences:** Possible restraining orders, probation restrictions, confiscation of tools used for entry.
