# \[2] 11 - Arson

**Offense Classification: Felony**

**Definition:**

Arson occurs when an individual **willfully and maliciously sets fire to or causes an explosion on property**, resulting in damage or destruction. This includes **burning buildings, vehicles, land, or personal property**, regardless of intent to harm others.

**Elements of the Crime:**

* The suspect **deliberately started a fire or caused an explosion**.
* The fire or explosion **resulted in damage to property**.
* The act was **not justified** (e.g., not an authorized controlled burn).

**Classification & Penalties:**

* **Standard Arson** *(If no injuries and damage is minimal.)*
  * **Jail Time:** 5 to 15 years
  * **Fine:** Up to $50,000
  * **Additional Consequences:** Mandatory restitution for property damage
* **Aggravated Arson** *(If the fire caused injuries, targeted occupied structures, or was set with intent to harm.)*
  * **Jail Time:** 15 years to life
  * **Fine:** Up to $100,000
  * **Additional Consequences:** Possible life sentence without parole in extreme cases
