# \[2] 12 - Looting

**Offense Classification: Misdemeanor / Felony&#x20;*****(Depending on circumstances and damage caused)***

**Definition:**

Looting occurs when an individual **steals, damages, or unlawfully removes property** during a **state of emergency, natural disaster, riot, or civil unrest**. This charge applies **regardless of store closures or abandoned property** and is considered more severe than standard theft due to the **exploitation of a crisis situation**.

**Elements of the Crime:**

* The suspect **unlawfully took, damaged, or removed property** during an emergency or civil unrest.
* The crime occurred **during or immediately following** a disaster, riot, or law enforcement-declared emergency.
* The suspect **acted with intent to benefit from the chaotic situation**.
* The act was **not justified** (e.g., not lawful emergency assistance efforts).

**Classification & Penalties:**

* **Misdemeanor** *(If minor property was taken or damaged.)*
  * **Jail Time:** Up to 12 months
  * **Fine:** Up to $5,000
  * **Additional Consequences:** Community service, mandatory restitution
* **Felony** *(If looting involved significant theft, force, or property damage.)*
  * **Jail Time:** 5 to 15 years
  * **Fine:** Up to $50,000
  * **Additional Consequences:** Enhanced penalties if weapons were used, probation restrictions
