# \[2] 17 - Insurance Fraud (Property Damage)

**Offense Classification: Felony**

**Definition:**

Insurance Fraud (Property Damage) occurs when an individual **deliberately damages or stages damage to property** with the intent to **file a fraudulent insurance claim for financial gain**. This includes **staging vehicle thefts, burning homes, or falsely reporting property loss**.

**Elements of the Crime:**

* The suspect **deliberately damaged or staged damage** to property.
* The suspect **submitted or attempted to submit a fraudulent insurance claim**.
* The act was **not justified** (e.g., not a legitimate insurance claim for real accidental damage).

**Penalties:**

* **Jail Time:** 5 to 15 years
* **Fine:** Up to $100,000
* **Additional Consequences:** Restitution to insurance providers, permanent fraud record
