# \[2] 18 - Utility Tampering

**Offense Classification: Misdemeanor / Felony&#x20;*****(Depending on severity and disruption caused)***

**Definition:**

Utility Tampering occurs when an individual **modifies, bypasses, or interferes with public or private utilities** to gain unauthorized access, avoid payment, or disrupt services. This includes **illegal power hookups, gas line tampering, and water theft**.

**Elements of the Crime:**

* The suspect **deliberately altered or tampered with** utility infrastructure.
* The act **provided unauthorized access, free services, or disrupted utility operations**.
* The act was **not justified** (e.g., not an emergency repair by a licensed professional).

**Classification & Penalties:**

* **Misdemeanor** *(If minor tampering without widespread impact.)*
  * **Jail Time:** Up to 6 months
  * **Fine:** Up to $5,000
  * **Additional Consequences:** Utility reconnection fees, probation restrictions
* **Felony** *(If tampering caused injury, financial loss, or citywide disruption.)*
  * **Jail Time:** 3 to 10 years
  * **Fine:** Up to $50,000
  * **Additional Consequences:** Possible state or federal charges if critical infrastructure was affected
