# \[2] 19 - Illegal Dumping

**Offense Classification: Misdemeanor / Felony&#x20;*****(Depending on hazardous material and location)***

**Definition:**

Illegal Dumping occurs when an individual **unlawfully disposes of waste, hazardous materials, or large objects in unauthorized locations**, such as **public streets, private land, or waterways**.

**Elements of the Crime:**

* The suspect **disposed of waste in a non-designated area**.
* The dumped materials **posed environmental, health, or public safety concerns**.
* The act was **not justified** (e.g., not an authorized disposal site).

**Classification & Penalties:**

* **Misdemeanor** *(If minor, non-toxic materials were dumped.)*
  * **Jail Time:** Up to 6 months
  * **Fine:** Up to $5,000
  * **Additional Consequences:** Community service, environmental cleanup restitution
* **Felony** *(If hazardous materials or large-scale dumping occurred.)*
  * **Jail Time:** 3 to 8 years
  * **Fine:** Up to $50,000
  * **Additional Consequences:** Federal environmental violations if toxic waste was involved
