# \[2] 25 – Theft of an Aircraft

**Offense Classification:** Felony

**Definition:**\
Theft of an Aircraft occurs when an individual unlawfully takes, operates, or controls an aircraft without the owner’s consent, with intent to deprive the owner of possession temporarily or permanently.

**Elements of the Crime:**

* The suspect took or operated an aircraft.
* The aircraft belonged to another person or entity.
* The suspect acted without consent and with intent to deprive.

**Classification & Penalties:**

* **Felony**
  * Jail Time: 3 to 5 years
  * Fine: $7,500 to $15,000
  * Additional Consequences: Restitution for recovery or damages, federal aviation involvement if applicable
