# \[2] 3 - Burglary

**Offense Classification: Felony**

**Definition:**

Burglary occurs when an individual **unlawfully enters a building, structure, or vehicle with the intent to commit a crime inside**, such as theft, assault, or vandalism. Unlike **Breaking and Entering**, this charge **requires criminal intent** beyond unlawful entry.

**Elements of the Crime:**

* The suspect **entered a structure, building, or vehicle** without permission.
* The suspect had **intent to commit a crime inside** (e.g., theft, vandalism, assault).
* The entry was **unlawful** (e.g., forced entry, breaking a window, unauthorized access).
* The act was **not justified** (e.g., not law enforcement with a warrant, not a tenant with legal rights).

**Penalties:**

* **Jail Time:** 5 to 15 years
* **Fine:** Up to $25,000
* **Additional Consequences:** Property restitution, extended probation, increased penalties if weapons were involved
