# \[2] 5 - Auto Theft (Grand Theft Auto)

**Offense Classification: Felony**

**Definition:**

Auto Theft, commonly referred to as **Grand Theft Auto (GTA),** occurs when an individual **unlawfully takes, uses, or permanently deprives another person of a motor vehicle** without consent.

**Elements of the Crime:**

* The suspect **took or operated a vehicle** without the owner's consent.
* The suspect **intended to permanently or temporarily deprive** the owner of the vehicle.
* The act was **not justified** (e.g., not a rental agreement dispute, not borrowing with permission).

**Penalties:**

* **Jail Time:** 5 to 15 years
* **Fine:** Up to $30,000
* **Additional Consequences:** Possible vehicle restitution, suspension of driving privileges, increased penalties for repeat offenders
