# \[2] 6 - Possession of Stolen Property

**Offense Classification: Misdemeanor / Felony&#x20;*****(Depending on value of stolen goods)***

**Definition:**

Possession of Stolen Property occurs when an individual **knowingly has, transports, or controls stolen goods** with intent to keep, sell, or benefit from them, even if they did not commit the theft.

**Elements of the Crime:**

* The suspect **was in possession of property that was stolen**.
* The suspect **knew or reasonably should have known** the property was stolen.
* The suspect **intended to keep, use, sell, or benefit** from the stolen goods.

**Classification & Penalties:**

* **Misdemeanor** *(If value is below $5,000)*
  * **Jail Time:** Up to 6 months
  * **Fine:** Up to $2,500
  * **Additional Consequences:** Possible restitution, community service
* **Felony** *(If value is $5,000 or more)*
  * **Jail Time:** 3 to 10 years
  * **Fine:** Up to $20,000
  * **Additional Consequences:** Confiscation of stolen property, probation restrictions
