# \[2] 8 - Extortion (Blackmail)

**Offense Classification: Felony**

**Definition:**

Extortion, also known as **Blackmail**, occurs when an individual **coerces another person into giving money, property, or services by threatening harm, exposure of information, or other forms of intimidation**. Unlike robbery, extortion **does not require immediate force or direct confrontation**.

**Elements of the Crime:**

* The suspect **made a threat** (physical, financial, reputational, or legal) against the victim.
* The threat was **used to obtain money, property, services, or influence**.
* The victim **felt compelled to comply due to the threat**.
* The act was **not justified** (e.g., not a lawful demand for payment of a legitimate debt).

**Penalties:**

* **Jail Time:** 5 to 15 years
* **Fine:** Up to $75,000
* **Additional Consequences:** Restitution to victims, loss of business licenses, enhanced penalties for public officials or law enforcement involvement
