# \[2] 9 - Vandalism

**Offense Classification: Misdemeanor / Felony&#x20;*****(Depending on damage value)***

**Definition:**

Vandalism occurs when an individual **willfully destroys, defaces, or damages property** that does not belong to them. This includes **graffiti, keying vehicles, smashing windows, and other intentional property damage**.

**Elements of the Crime:**

* The suspect **intentionally caused damage** to property.
* The property **belonged to another person, business, or government entity**.
* The act was **not justified** (e.g., not accidental damage, not self-defense).

**Classification & Penalties:**

* **Misdemeanor** *(If damage is below $5,000)*
  * **Jail Time:** Up to 6 months
  * **Fine:** Up to $5,000
  * **Additional Consequences:** Community service, mandatory restitution
* **Felony** *(If damage is $5,000 or more, or if government property was targeted)*
  * **Jail Time:** 3 to 10 years
  * **Fine:** Up to $25,000
  * **Additional Consequences:** Probation restrictions, enhanced penalties for repeat offenders
