# \[3] 1 - Resisting Arrest (Without Violence)

**Offense Classification: Misdemeanor**

**Definition:**

Resisting Arrest (Without Violence) occurs when an individual **knowingly obstructs or delays a law enforcement officer’s lawful attempt to make an arrest or detention** without using physical force, threats, or violence. This can include **verbal refusal, noncompliance, or passive resistance.**

**Elements of the Crime:**

* The suspect **knowingly failed to comply** with a lawful command to submit to arrest.
* The suspect **did not use physical force, threats, or violence.**
* The officer was **engaged in lawful duties at the time of the arrest.**
* The act was **not justified** (e.g., not exercising a legitimate legal defense).

**Penalties:**

* **Jail Time:** Up to 6 months
* **Fine:** Up to $2,500
* **Additional Consequences:** Probation restrictions, mandatory compliance training
