# \[3] 14 - Failure to Disperse

**Offense Classification: Misdemeanor**

**Definition:**

Failure to Disperse occurs when an individual **refuses to leave a public area after being ordered by law enforcement during a riot, public disturbance, or emergency situation.**

**Elements of the Crime:**

* The suspect was **ordered to leave a public area by law enforcement.**
* The suspect **refused to comply** and remained at the scene.
* The act was **not justified** (e.g., not an emergency or legally permitted assembly).

**Penalties:**

* **Jail Time:** Up to 6 months
* **Fine:** Up to $2,500
* **Additional Consequences:** Probation restrictions, mandatory training on public safety protocols
