# \[3] 15 - Unlawful Protest or Assembly

**Offense Classification: Misdemeanor / Felony&#x20;*****(Depending on severity)***

**Definition:**

Unlawful Protest or Assembly occurs when individuals **gather or demonstrate in a manner that violates local, state, or federal laws**, such as **blocking public roadways, occupying restricted areas, or failing to obtain necessary permits**.

**Elements of the Crime:**

* The individuals **engaged in a gathering or demonstration.**
* The assembly violated **applicable legal requirements** (e.g., no permit, occupying restricted zones, refusing to follow local ordinances).
* The conduct caused **disruption, danger, or interference with public order.**
* The act was **not justified** (e.g., not an approved event or emergency situation).

**Penalties:**

* **Misdemeanor:** *(If the assembly caused minor disruption.)*
  * **Jail Time:** Up to 6 months
  * **Fine:** Up to $2,500
* **Felony:** *(If the assembly caused significant harm, blocked critical infrastructure, or led to violence.)*
  * **Jail Time:** 3 to 8 years
  * **Fine:** Up to $10,000
  * **Additional Consequences:** Probation restrictions, possible restraining orders on future protests
