# \[3] 19 - Corruption & Abuse of Power

**Offense Classification: Felony**

**Definition:**

Corruption & Abuse of Power occurs when a government employee or public official **uses their position of authority to gain unlawful benefits, grant undue favors, or commit unethical acts** that violate the public trust.

**Elements of the Crime:**

* The suspect **was a government employee or public official.**
* The suspect **used their position to gain unlawful personal or financial benefit.**
* The act was **intentional and violated ethical standards or legal duties.**
* The act was **not justified** (e.g., not part of lawful duties or public service).

**Penalties:**

* **Jail Time:** 5 to 15 years
* **Fine:** Up to $100,000
* **Additional Consequences:** Permanent disqualification from public office, possible federal charges
