# \[3] 2 - Obstruction of Justice

**Offense Classification: Misdemeanor / Felony&#x20;*****(Depending on severity)***

**Definition:**

Obstruction of Justice occurs when an individual **interferes with the judicial process** by **tampering with evidence, threatening witnesses, bribing officials, or otherwise hindering legal proceedings**. Unlike **Hindering an Investigation**, this charge applies to actions that affect **courts, prosecutors, or the overall administration of justice**, not just police investigations.

**Elements of the Crime:**

* The suspect **deliberately took actions** that interfered with a legal case or judicial proceeding.
* The actions were **intended to undermine the legal process**, including investigations, trials, or sentencing.
* The act was **not justified** (e.g., not a legitimate defense or lawful activity).

**Penalties:**

* **Misdemeanor:** *(If minor interference.)*
  * **Jail Time:** Up to 12 months
  * **Fine:** Up to $5,000
* **Felony:** *(If significant harm to justice occurred, such as threatening witnesses or destroying key evidence.)*
  * **Jail Time:** 3 to 10 years
  * **Fine:** Up to $50,000
