# \[3] 26 - Conspiracy to Commit a Crime

**Offense Classification:** **Felony** *(Severity depends on the underlying offense being conspired)*

#### **Definition:**

Conspiracy to Commit a Crime occurs when **two or more individuals agree to engage in criminal conduct** and **take at least one overt act** in furtherance of that plan. The crime does not need to be successfully completed; the agreement and any preparatory act are sufficient to support a conspiracy charge.

#### **Elements of the Crime:**

* **Two or more persons** entered into an agreement to commit a specific criminal offense.
* The agreement was **intentional and mutual** — not accidental or coincidental.
* At least **one of the individuals committed an overt act** to further the planned crime.
* The underlying planned offense is **a crime under San Andreas law**.

#### **Penalties:**

**Felony:** *(Default unless underlying crime is only a misdemeanor)*

* **Jail Time:** Up to **75% of the maximum penalty** for the intended crime
* **Fine:** Up to **50% of the maximum fine** for the intended crime
* **License Suspension:** Optional, if related to the planned crime (e.g., vehicle, firearm, or professional license)

**Additional Consequences:**

* **May be charged even if the crime was never completed**
* **Each participant may be charged independently** regardless of who committed the overt act
* **May enhance penalties for other associated charges**
