# \[3] 27 - Aiding and Abetting

**Offense Classification:** **Misdemeanor / Felony** *(Matches the classification of the principal offense)*

#### **Definition:**

Aiding and Abetting occurs when an individual **knowingly assists, facilitates, encourages, or enables another person to commit a crime**. The individual does not have to be the one who physically commits the offense — merely contributing to its commission is sufficient for criminal liability.

#### **Elements of the Crime:**

* A **principal offense** was committed by another person.
* The individual **intentionally aided, assisted, or encouraged** the commission of that offense.
* The individual **was aware of the unlawful nature** of the act at the time they provided support.
* The individual’s actions were **voluntary and contributed in a meaningful way** to the offense.

#### **Penalties:**

**Misdemeanor or Felony:**

* **Same as the principal offense** (the crime that was aided or abetted)
* May include **jail time, fines, and additional penalties** equal to those for the underlying offense

**Additional Consequences:**

* **Liability attaches even if the aider was not present at the scene**
* **Does not require completion of the crime**, only that it was attempted or carried out by the principal
* **Aiding and abetting multiple crimes may result in multiple charges**
