# \[3] 32 – Attempted Jailbreak

**Offense Classification:** Felony

**Definition:**\
Attempted Jailbreak occurs when an individual, with intent to escape from custody, takes substantial steps toward escaping but does not succeed.

**Elements of the Crime:**

* The suspect was lawfully confined or assisting someone confined.
* The suspect attempted or prepared an escape.
* The escape was not completed.

**Classification & Penalties:**

* **Felony**
  * Jail Time: 1 to 4 years
  * Fine: $3,000 to $8,000
  * Additional Consequences: Forfeiture of tools used in attempt, extended security measures upon re-incarceration
