# \[3] 33 – Possession of Contraband in a Government Facility

**Offense Classification:** Misdemeanor / Felony (depending on item)

**Definition:**\
Possession of Contraband in a Government Facility occurs when an individual unlawfully introduces or possesses prohibited items within a jail, courthouse, or other restricted government building.

**Elements of the Crime:**

* The suspect possessed or introduced a prohibited item into a government facility.
* The item is unauthorized or restricted by law or policy.
* The act was intentional and without lawful authority.

**Classification & Penalties:**

* **Misdemeanor** (non-hazardous contraband, e.g., cell phones, tobacco, tools):
  * Jail Time: Up to 12 months
  * Fine: $1,000 to $2,500
* **Felony** (hazardous or security-threat contraband, e.g., weapons, narcotics, explosives):
  * Jail Time: 2 to 6 years
  * Fine: $5,000 to $12,000
  * Additional Consequences: Forfeiture of contraband, facility security enhancements
