# \[3] 35 – Misuse of Emergency Systems

**Offense Classification:** Misdemeanor / Felony (depending on severity)

**Definition:**\
Misuse of Emergency Systems occurs when an individual knowingly makes false, frivolous, or abusive use of emergency phone lines, dispatch systems, or alerts, disrupting public safety operations.

**Elements of the Crime:**

* The suspect knowingly made a false or abusive emergency report.
* The report caused or risked disrupting emergency services.
* The act was intentional and without lawful purpose.

**Classification & Penalties:**

* **Misdemeanor** (non-credible or prank emergency calls):
  * Jail Time: Up to 12 months
  * Fine: $1,000 to $2,500
* **Felony** (serious disruption, such as swatting or causing large-scale deployment):
  * Jail Time: 2 to 6 years
  * Fine: $5,000 to $10,000
  * Additional Consequences: Restitution for deployment costs, federal charges if cross-jurisdictional
