# \[3] 37 – Public Intoxication

**Offense Classification:** Infraction / Misdemeanor (depending on conduct)

**Definition:**\
Public Intoxication occurs when an individual is under the influence of alcohol, drugs, or controlled substances in a public place to a degree that causes a disturbance, safety hazard, or risk to themselves or others.

**Elements of the Crime:**

* The suspect was under the influence of alcohol, drugs, or controlled substances.
* The suspect was in a public place.
* The intoxication caused, or reasonably could cause, disturbance, danger, or interference with public safety.

**Classification & Penalties:**

* **Infraction** (minor intoxication without threats to safety, e.g., sleeping on a bench, mild disturbance):
  * Fine: $250 to $750
  * Additional Consequences: Temporary police hold for detox, release without formal custody record
* **Misdemeanor** (intoxication that creates danger, disorderly conduct, or refusal to comply with officers):
  * Jail Time: Up to 6 months
  * Fine: $1,000 to $2,500
  * Additional Consequences: Court-ordered treatment or alcohol education program
