# \[3] 4 - Tampering with Evidence

**Offense Classification: Felony**

**Definition:**

Tampering with Evidence occurs when an individual **intentionally destroys, conceals, alters, or fabricates physical evidence** with the purpose of **impairing its integrity or availability** in a legal investigation or proceeding.

**Elements of the Crime:**

* The suspect **knowingly altered or destroyed evidence.**
* The evidence was **material to a legal investigation or proceeding.**
* The act was **intentional and deliberate.**
* The act was **not justified** (e.g., not accidental damage).

**Penalties:**

* **Jail Time:** 5 to 15 years
* **Fine:** Up to $50,000
* **Additional Consequences:** Possible federal charges if evidence tampering interferes with a federal investigation
