# \[3] 7 - Failure to Identify to Law Enforcement

**Offense Classification: Misdemeanor**

**Definition:**

Failure to Identify to Law Enforcement occurs when an individual **knowingly refuses to provide their name, identification, or truthful information** to a law enforcement officer during a lawful stop, detention, or arrest.

**Elements of the Crime:**

* The suspect was **lawfully stopped, detained, or arrested.**
* The suspect **refused to provide their name or provided false information.**
* The act was **intentional and not justified** (e.g., not due to confusion or misunderstanding).

**Penalties:**

* **Jail Time:** Up to 6 months
* **Fine:** Up to $2,500
* **Additional Consequences:** Probation restrictions, potential impact on future detentions
