# \[3] 8 - Impersonating a Police Officer

**Offense Classification: Misdemeanor / Felony&#x20;*****(Depending on intent and harm caused)***

**Definition:**

Impersonating a Police Officer occurs when an individual **falsely claims to be law enforcement** with the intent to **gain unauthorized access, commit a crime, or deceive others into compliance.**

**Elements of the Crime:**

* The suspect **knowingly presented themselves as a police officer.**
* The suspect **did not hold a law enforcement position.**
* The act **was intended to deceive or gain unauthorized access or compliance.**
* The act was **not justified** (e.g., not part of a lawful role-playing or costume event).

**Penalties:**

* **Misdemeanor:** *(If no harm or serious deception occurred.)*
  * **Jail Time:** Up to 12 months
  * **Fine:** Up to $2,500
* **Felony:** *(If the impersonation caused harm, financial loss, or serious disruption.)*
  * **Jail Time:** 3 to 10 years
  * **Fine:** Up to $25,000
  * **Additional Consequences:** Confiscation of related equipment, loss of professional licenses
