# \[3] 9 - Impersonating a Government Official

**Offense Classification: Misdemeanor / Felony&#x20;*****(Depending on intent and harm caused)***

**Definition:**

Impersonating a Government Official occurs when an individual **falsely claims to hold a government position**—such as a federal agent, elected representative, or bureaucratic official—with the intent to **gain unauthorized access, commit fraud, or deceive others into compliance.**

**Elements of the Crime:**

* The suspect **knowingly presented themselves as a government official.**
* The suspect **did not hold that official position.**
* The act **was intended to deceive, gain access, or commit fraud.**
* The act was **not justified** (e.g., not part of lawful role-playing or costume event).

**Penalties:**

* **Misdemeanor:** *(If no harm or serious deception occurred.)*
  * **Jail Time:** Up to 12 months
  * **Fine:** Up to $2,500
* **Felony:** *(If the impersonation caused harm, financial loss, or serious disruption.)*
  * **Jail Time:** 3 to 10 years
  * **Fine:** Up to $25,000
  * **Additional Consequences:** Confiscation of related equipment, loss of professional licenses
