# \[4] 10 - Counterfeiting

**Offense Classification: Felony**

**Definition:**

Counterfeiting occurs when an individual **produces, possesses, or distributes fake currency, government documents, or branded products** to deceive or commit fraud.

**Elements of the Crime:**

* The suspect **created, used, or attempted to distribute fake money, documents, or items**.
* The counterfeit items were **designed to deceive another party**.
* The act was **not justified** (e.g., not for educational or artistic purposes).

**Penalties:**

* **Felony:**
  * **Jail Time:** 5 to 15 years
  * **Fine:** Up to $250,000
  * **Additional Consequences:** Asset forfeiture, restitution, business license revocation
